1. Acceptance of Terms

By accessing or using the GymLinx platform, you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use our services. These terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to update these terms at any time. We will notify you of material changes via email or through a prominent notice on our platform.

2. Service Description

GymLinx provides a cloud-based gym management platform that includes member management, billing automation, class scheduling, performance analytics, and communication tools. The platform is provided "as is" and "as available."

We continuously improve and update our platform. Features may be added, modified, or removed at our discretion. We will provide reasonable notice for significant changes that affect core functionality.

3. User Accounts

You are responsible for maintaining the security of your account credentials. You must immediately notify us of any unauthorized access. GymLinx cannot be held liable for losses arising from unauthorized use of your account.

• You must be at least 18 years old to create an account.
• You must provide accurate and complete registration information.
• You are responsible for all activity under your account.
• You must not share your account credentials with third parties.

4. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We may change our pricing with 30 days' notice.

If payment fails, we will attempt to charge your payment method up to three times. After the third failed attempt, your account may be downgraded to the free tier.

5. Intellectual Property

The GymLinx platform, including its original content, features, and functionality, is owned by GymLinx Technologies and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of data you input into the platform.

6. Limitation of Liability

In no event shall GymLinx, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the Service.

7. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately. Data export is available for 30 days after termination.

8. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Travis County, Texas.
